Personal Data: Name, email address, phone/WhatsApp number, country of residence, preferred language, booking details, service history, testimonials (if you consent), and documents you choose to share (e.g., CV, academic records for admissions guidance).

Payment & Transaction Data: Processed securely by our payment providers (e.g., Topmate, Calendly, Bank Transfer). We receive limited transaction metadata (amount, status) and do not store full card details.

Usage Data: IP address, device, browser type, operating system, pages visited, time on page, and referral source (via cookies/analytics if you consent).

Communications Data: Emails, WhatsApp messages, and form submissions related to bookings or support.

Special Categories: We do not intentionally collect sensitive data (health, etc.). If wellbeing topics arise, we recommend you do not share medical data. If you do, we process it only with your explicit consent and solely to support your request.

1) Introduction

These Terms & Conditions (“Terms”) govern your use of Aavior Ltd’s websites, booking pages (including Topmate, Calendly), services, digital products, courses, and participation in any live or recorded sessions (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

2) Who We Are & Scope of Services

Aavior provides:

• Mentorship & Transition Support: Pre-arrival and post-arrival guidance, relocation, wellbeing, academic readiness, job-search preparation.
• English Language Training: ESL/EFL, Academic English, IELTS, and professional communication.
• UK University Admissions Guidance: Course/university matching, SOP/document support, timeline planning (general guidance only).
• Short Courses & Cohorts:  program and other workshops.
• One-to-One Sessions: CV/cover letter reviews, interview prep, speaking practice, parent guidance calls.
• Academic Teaching & Assessment (B2B): Delivered to universities under separate institutional contracts.

Important: We do not provide OISC-regulated immigration advice or legal advice. We do not write, edit, or complete student assignments.

3) Account, Eligibility & Conduct

• You must be 18+ to use our Services. Under-18s require written parent/guardian consent and a guardian present for the first session.
• You agree to provide accurate information and to behave respectfully toward staff and participants. Abusive, discriminatory, or disruptive conduct may result in immediate termination without refund.

4) Booking, Scheduling & Attendance

• Bookings are confirmed only after full payment through our approved platforms (e.g., Topmate, Calendly or invoice/Bank Transfer.)
• Rescheduling: You may reschedule once per session with ≥24 hours’ notice via the original booking method.
• No-shows / Late Cancellations (<24h): Charged in full and counted as used.
• Start Times: Late arrival reduces session time; we will still end on schedule.

5) Subscription Plans (Pre-Arrival + post-arrival)

• Plans run monthly (e.g., 2-month pre/post packages). Inclusions (calls, WhatsApp windows, reviews) are set at purchase.
• Use-by: Session quotas and support windows expire at the end of the plan; unused items don’t roll over.
• Upgrades are possible subject to availability and additional fees.

6) One-to-One Services

• Session scope is described on the service page (e.g., “CV & Cover Letter”, “Interview Prep”, “English Speaking”).
• We provide guidance and feedback; outcomes (interviews/offers/grades) aren’t guaranteed.

7) English / IELTS / Academic English Training

• Delivered one-to-one or in small groups. Levels and objectives will be agreed in advance.
• Certificates of completion (where applicable) reflect attendance/participation; they are not formal qualifications unless explicitly stated.

8) UK University Admissions Guidance

• We offer general guidance: course selection, timelines, SOP/document review, and application support processes.
• We may share your documents with institutions/partners only with your permission and solely to progress your application.
• Admissions decisions, scholarships, and visa outcomes are outside our control and not guaranteed.
• For immigration advice, we signpost to OISC-regulated advisers/solicitors.

9) Short Courses & Cohorts 

• Syllabus, dates, and deliverables are listed on the course page. We may adapt topics to maximise outcomes.
• Refunds for cohorts: see Section 12.
• Group chat/community access (if offered) is time-limited (e.g., until course ends or for a stated period).

10) Community & Group Guidelines (WhatsApp/Telegram/LinkedIn)

• Use group channels for program-related queries; avoid unsolicited DMs to coaches.
• Response window: Mon–Fri, within 24 hours where feasible (not guaranteed on weekends).
• Access ends when your plan/course ends (or as specified on the service page).

11) Technology & Access

• Ensure a stable internet connection, a compatible device, and up-to-date Chrome/Edge/Firefox for calls and platforms we use.
• We are not responsible for device/workplace restrictions (VPN, firewalls, admin locks).
• Digital products are delivered by email/portal; access durations are specified per product.

12) Payments, Refunds & Cancellations

Payments

• All fees are payable in advance. Services start after funds clear.
• Prices may be displayed in GBP or INR; bank/FX charges are the client’s responsibility.

Cooling-Off (UK Distance Selling)

• If you purchase online, you may have a 14-day cooling-off right unless you ask us to start immediately. By requesting immediate delivery (e.g., booking a near-term session), you consent to immediate performance and waive your right to cancel once the service is fully delivered.

Refunds (General)

• Single sessions: Non-refundable once delivered; reschedule once with ≥24h notice (Section 4).
• Subscriptions: Non-refundable once delivery begins.
• Cohorts / Short Courses: Refund available if you cancel ≥7 days before the start date. No refunds thereafter.
• Digital Products (PDFs, recordings, templates): Non-refundable once accessed/downloaded.

Late/Failed Payments

• Invoices overdue by 7+ days may incur up to 5% monthly interest and/or access suspension until paid.

13) Academic Integrity

• We do not write, edit, or complete assignments. We offer structure, planning, and study skills guidance only.
• You are solely responsible for your submissions and for complying with your institution’s academic policies.

14) Immigration Guidance Disclaimer (OISC)

• We provide general information on UK student/graduate routes (documents, timelines, signposting).
• We are not OISC-regulated and do not provide immigration/legal advice. We can refer to licensed advisers when requested.

15) Intellectual Property & Recordings

• All Aavior materials (slides, PDFs, videos, templates, trackers) are Aavior Ltd copyright.
• You receive a personal, non-transferable licence to use them. No sharing, resale, or public distribution.
• Sessions are not recorded unless both parties agree in writing. If recorded, you consent to our handling per our Privacy Notice.

16) Marketing, Testimonials & Case Studies

• With your explicit consent, we may use testimonials, anonymised results, or non-confidential success stories in marketing (website, socials, brochures).
• You can withdraw marketing consent at any time by emailing contact@aavior.com (this won’t affect lawful processing already done).

17) B2B Teaching & Marking (Universities)

• Institutional engagements (module delivery, marking, moderation) are governed by separate written contracts.
• These Terms apply only to the extent they don’t conflict with those agreements.

18) Affiliate / Consultancy Partners

• Referral or partner commissions are governed by a separate MoU/affiliate agreement.
• No commission is payable on refunds, chargebacks, or unpaid invoices.

19) Data Protection & Privacy (UK GDPR)

• We process personal data to deliver the Services, manage bookings, and improve operations in line with UK GDPR and our Privacy Notice (see footer link).
• Third-party processors (e.g., Top mate, Calendly) have their own privacy terms.
• Your rights include access, rectification, erasure, objection, restriction, portability, and withdrawal of consent where applicable.

20) Limitation of Liability

• We use reasonable skill and care but do not guarantee specific outcomes (admission, visa approval, job offers, grades).
• We are not liable for indirect, incidental, special, or consequential losses.
• Our total liability for any claim is limited to the amount you paid for the affected service.

21) Force Majeure

• We aren’t responsible for delays/failures caused by events beyond our control (e.g., illness, strikes, outages, policy changes, travel disruption). We will offer a reasonable alternative where possible.

22) Changes to Services or Terms

• We may update the Services or these Terms from time to time. The latest version will be posted on our website and applies from its effective date. Continued use constitutes acceptance.

23) Complaints

• Email contact@aavior.com with your name, booking ID, and details.
• We’ll acknowledge within 3 working days and aim to resolve within 14 working days. If unresolved, we may propose mediation/ADR.

24) Governing Law & Jurisdiction

• These Terms are governed by the laws of England & Wales, and disputes are subject to the exclusive jurisdiction of its courts.
